Model Policy on Responding to Reports of Sexual Abuse and Harassment, Protection of Victims, Reporting to Other Facilities



All detention staff members are mandatory reporters and must make reports in accord with agency policy and ORS 419B.005 to 419B.050

In addition to mandatory reporting, staff must immediately report to a supervisor or manager all information of sexual abuse or harassment, retaliation for reporting, or neglect contributing to abuse or retaliation in any facility. Staff must limit information dissemination to those staff that need to know the information. Notes made in JJIS must be restricted so that only staff directly involved with the resident have access.

Medical and mental health professionals must report in accord with this policy and specifically tell residents about their duty to report before beginning an initial meeting or screening.

Upon receiving an allegation of sexual abuse or harassment, a supervisor or manager is responsible for notifying the detention manager and/or agency director who is responsible for immediately notifying:

All notifications must be documented in writing.

Upon receiving a report, the detention facility takes immediate action to protect the victim in any allegation of substantial risk of sexual abuse. Action may include a higher level of supervision, transfer to another unit or facility, assessment of vulnerability, referral to advocacy and mental health services.

Upon receiving an allegation of sexual abuse at another facility, the agency policy is to ensure that the administrator of the other facility is notified in writing immediately, not later than 72 hours. If this agency receives notification that a youth in another facility was sexually abused while at this facility, the allegation is investigated.
